For high earners and founders in particular, the financial case is compelling — but it comes with rules worth understanding before you act.

The Nevada tax picture

Nevada is one of only nine U.S. states with no personal state income tax. That means no state tax on wages, salaries, dividends, interest, capital gains, retirement income, or Social Security. Nevada funds itself primarily through sales tax, gaming taxes, and a modified business tax on payroll — not income.

Nevada residency requires physical presence — generally 183-plus days per year — plus genuine domicile: a Nevada driver's license, voter registration, vehicle registration, a real Nevada home, and your center of life shifting to Nevada. But the harder half of the equation is California's side. California does not use a clean bright-line day count to let you leave. Its Franchise Tax Board applies a facts-and-circumstances domicile test, and it presumes your California domicile continues until you prove you've abandoned it. In other words, you have to demonstrate you genuinely left California — not merely that you arrived in Nevada.

The FTB audits former high-earning residents aggressively, can look back several years, and counts partial days in California as full California days. Common audit triggers include keeping a California home, a spouse or family remaining in California, maintaining a California driver's license or professional licenses, continuing California business operations, and keeping California doctors, attorneys, and club memberships.

None of this should discourage a legitimate move — Nevada's zero-income-tax status is a long-standing feature of state law, and you're entitled to pay taxes where you actually live.
