Does This Incline Village Home Come With Beach Access? IVGID Privileges and the 1968 Deed Rule Explained

The short answer

TL;DR: Not every home in Incline Village comes with beach access. Only parcels that were inside the Incline Village General Improvement District (IVGID) on June 4, 1968, and that pay the annual Beach Facility Fee, can use Incline Beach, Burnt Cedar Beach, Ski Beach and Hermit Beach. Parcels annexed after that date, including Crystal Bay, do not qualify. Access belongs to the parcel, not the owner, so it transfers with the property when it sells. Check the Washoe County tax bill for a Beach Facility Fee line and confirm with IVGID before you write an offer.

If you are shopping for a home in Incline Village, this is the first question to ask about any address. The beaches are private, gated and staffed, and a home without access can look identical on a listing sheet to one with it.

What the 1968 Beach Deed says

IVGID acquired the beaches by a deed made on June 4, 1968 and recorded in Washoe County. That deed restricts the beaches to recreation "by, and for the benefit of, property owners and their tenants" and, as the Board of Trustees may determine, "the guests of such property owners."

IVGID applies the deed through Ordinance 7, most recently amended on May 13, 2026. Three points matter to a buyer:

  • The cutoff is a boundary date. Only parcels located within the District as of June 4, 1968 are eligible for beach access.
  • Annexed parcels are excluded. The ordinance states that parcels annexed to the District after June 4, 1968 are not eligible, per the deed restrictions.
  • The beaches are not public. The ordinance describes them as restricted access facilities.

The restriction has been tested in court. In Wright v. Incline Village General Improvement District (2011), the Ninth Circuit upheld IVGID's policy of limiting the beaches to those who own or rent within the 1968 boundaries.

Both kinds of parcel receive IVGID recreation privileges. The difference is the beaches and the boat ramp.

Every eligible parcel can receive up to five cards in any mix of Picture Passes and Punch Cards. A Picture Pass is a photo ID for one person. A Punch Card carries a dollar value that you or your guests spend down.

Fees are set each year by the Board and have moved a lot. The combined fee was $450 in 2024-25, $1,375 in 2025-26 and $1,530 in 2026-27, according to IVGID's Facility Fee FAQ. Budget for the fee to change.

How to verify a property before you write an offer

Do not rely on the listing remarks or the street name. Verify it yourself, in this order:

  1. Read the Washoe County tax bill. IVGID fees are collected on the property tax bill. A parcel with beach access is assessed a Beach Facility Fee in addition to the Recreation Facility Fee.
  2. Call the IVGID Parks & Recreation counter. Staff at the Recreation Center (980 Incline Way, 775-832-1310) can confirm a parcel's status.
  3. Confirm the fees are current. A parcel keeps its privileges only if property taxes and IVGID fees are paid for the current and prior years.
  4. Put it in writing. Ask your agent to make beach access status part of your due diligence, so you can walk away if the answer is not what was represented.

Vacant land needs extra care. A lot with no building must be a buildable lot to count as an eligible parcel.

What happens to passes at closing

Beach access stays with the parcel, but the plastic does not. Under Ordinance 7:

  • The seller's Picture Passes expire when the parcel changes ownership and must be returned to IVGID.
  • The seller's Punch Cards are invalidated, whatever balance is left on them.
  • The new owner applies for new cards with a government photo ID and proof of ownership, either the recorded deed or confirmation from the County Assessor.
  • If the old cards are not returned, IVGID can charge the new owner a fee per card.

Buying in an LLC or a trust is common here and it works, with one extra step. The entity designates one individual in writing to direct who receives the parcel's cards, and the parcel still receives only one parcel's allotment.

Guests, tenants and short-term rentals

Family. An owner can assign Picture Passes to relatives on IVGID's Family Tree, which covers parents, children, grandparents, grandchildren, siblings and their spouses.

Guests. A Picture Pass holder can bring up to 15 guests per parcel per day by meeting them at the gate and paying the guest fee. An owner can also hand a Punch Card to a guest, who can then enter without the owner until the balance runs out. Larger groups need a reservation approved in advance.

Long-term tenants. A tenant with a written lease of six months or more can be assigned the parcel's privileges, including beach access if the parcel has it.

Short-term rentals. A renter with a lease under six months cannot receive a Picture Pass or Punch Card in their own name. Ordinance 7 also prohibits commercial use of the beaches and prohibits marketing beach access in connection with anything offered for sale or lease. If you plan to rent a home short term, ask IVGID how those rules apply before you advertise the beaches as an amenity. Violations can cost a parcel its privileges for up to two years.

Frequently asked questions

Do all Incline Village homes have beach access?

No. Only parcels that were within IVGID's boundaries on June 4, 1968 and that pay the Beach Facility Fee have access to the four IVGID beaches.

Do Crystal Bay homes have IVGID beach access?

No. Crystal Bay parcels sit outside the 1968 boundaries, so they receive IVGID recreation privileges without beach access.

Does beach access transfer when a home sells?

Yes. Eligibility belongs to the parcel. The seller's passes and Punch Cards are cancelled at the ownership change, and the buyer applies for new ones.

Do condos get beach access?

A condo is treated like any other parcel. Each dwelling unit that is on the recreation roll and pays the Beach Facility Fee receives its own allotment of up to five cards.

Can I buy beach access for a home that does not have it?

No. Eligibility comes from the 1968 deed, not from a fee you can opt into. Owners of parcels without access can enter only as the paying guest of a pass holder who has it.
