Measure T Overturned: What It Means for Lake Tahoe Real Estate and Vacation Rentals

As a top Lake Tahoe real estate agent, I've closely monitored the legal battles surrounding Measure T in South Lake Tahoe. This measure, passed in 2018, aimed to phase out vacation home rentals (VHRs) in residential areas by the end of 2021, while still permitting them in designated commercial zones and the Tourist Core Area.

A significant exception within Measure T allowed permanent residents to rent their properties on a short-term basis for up to 30 days per year. This provision became a focal point in legal challenges, with opponents arguing it discriminated against non-resident property owners.

On March 13, 2025, El Dorado County Superior Court Judge Gary Slossberg ruled that this permanent resident exception violated the Dormant Commerce Clause of the U.S. Constitution. He determined that the exception couldn't be severed from the rest of the measure, rendering Measure T unconstitutional and void.

The city now has 60 days from the entry of judgment to decide whether to appeal this decision.

This ruling has significant implications for the local real estate market. With the ban on VHRs lifted, property owners can once again consider short-term rentals, potentially increasing the attractiveness of investing in Lake Tahoe homes. This change may lead to a surge in demand for properties suitable for vacation rentals, influencing property values and availability.
