Lake Tahoe
If you're considering buying a vacation home in Lake Tahoe, one of the most important things to understand is the short-term rental (STR) permitting process—and how it changes depending on what side of the lake you’re on.
As a full-time Lake Tahoe real estate agent with Compass, I get this question constantly:
“Can I Airbnb this home?”
The answer? It depends—a lot—on whether the property is in Washoe County, NV, Placer County, CA, or Douglas County, NV.
Let’s break it down county by county so you don’t end up buying a dream home that turns into a legal headache.
Current STR Policy: Regulated + Tiered Permit System
Washoe County allows short-term rentals, but they’ve established a structured, tiered permitting system:
Tier 1: Owner-occupied homes renting less than 28 days/year. Easier to permit.
Tier 2: Non-owner-occupied STRs—must comply with fire/life/safety inspections, parking, bear box installation, and occupancy limits.
Cap: No official cap, but density restrictions apply.
Fees: Application fees start at ~$1,500+ with annual renewals.
Local Insight: Incline Village has seen more scrutiny recently, so expect tighter enforcement going forward.
If you're buying in Washoe County, it’s crucial to verify zoning and HOA restrictions with a knowledgeable Lake Tahoe realtor before making an offer.
Current STR Policy: Capped + Highly Regulated
Placer County has taken one of the strictest approaches around the lake.
Cap: 3,900 total STR permits allowed in unincorporated eastern Placer County (which includes most of North Lake Tahoe).
Permit Freeze: At times, new permits have been paused due to reaching capacity.
Permit Requirements: Good neighbor policies, parking compliance, occupancy limits, and 24/7 local contact.
Fees: Annual fees + Transient Occupancy Tax (TOT).
Waitlist: If the cap is hit, new buyers go on a waitlist.
Pro tip: In this market, buying a property with an existing STR permit is gold. As your Lake Tahoe real estate agent, I’ll help you spot these rare listings before they hit the general market.
Current STR Policy: Zoned + Capped with Lottery System
Douglas County is divided into STR-eligible and STR-restricted zones.
Cap: 600 permits total for the Tahoe Township area.
Zoning: STRs only allowed in Tourist Commercial and certain Residential zones.
Lottery System: When permits are maxed out, new applicants enter a lottery or waitlist.
Rules: Mandatory inspections, bear-proof trash containers, parking limits, fire safety standards.
Fines: Violations can lead to hefty fines or permit revocation.
Buyers looking at Douglas County should be especially cautious—not every neighborhood is eligible. A trusted Lake Tahoe realtor can save you from costly mistakes.
Whether you're searching Lake Tahoe homes for sale as a pure investment or a part-time getaway that can generate rental income, STR permitting is something you need to get right before you close.
As a top Lake Tahoe real estate agent, I specialize in helping buyers:
Understand STR rules across county lines
Find properties with active or transferrable STR permits
Avoid zoning pitfalls and HOA restrictions
If you’re serious about buying smart in Tahoe, I’ll help you navigate the rules—and find the right property for your goals.
