As a full-time Lake Tahoe real estate agent with Compass, I get this question constantly:
“Can I Airbnb this home?”
The answer? It depends—a lot—on whether the property is in Washoe County, NV, Placer County, CA, or Douglas County, NV.
Let’s break it down county by county so you don’t end up buying a dream home that turns into a legal headache.
Current STR Policy: Regulated + Tiered Permit System
Washoe County allows short-term rentals, but they’ve established a structured, tiered permitting system:
Tier 1: Owner-occupied homes renting less than 28 days/year. Easier to permit.
Tier 2: Non-owner-occupied STRs—must comply with fire/life/safety inspections, parking, bear box installation, and occupancy limits.
Cap: No official cap, but density restrictions apply.
Fees: Application fees start at ~$1,500+ with annual renewals.
Local Insight: Incline Village has seen more scrutiny recently, so expect tighter enforcement going forward.
If you're buying in Washoe County, it’s crucial to verify zoning and HOA restrictions with a knowledgeable Lake Tahoe realtor before making an offer.
Current STR Policy: Capped + Highly Regulated
Placer County has taken one of the strictest approaches around the lake.
Cap: 3,900 total STR permits allowed in unincorporated eastern Placer County (which includes most of North Lake Tahoe).
Permit Freeze: At times, new permits have been paused due to reaching capacity.
Permit Requirements: Good neighbor policies, parking compliance, occupancy limits, and 24/7 local contact.
Fees: Annual fees + Transient Occupancy Tax (TOT).
Waitlist: If the cap is hit, new buyers go on a waitlist.
